Terms of Use and Conditions


This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the Trigeia Services. By using the Trigeia Services, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse the Trigeia Website) "Client" (which means that you have registered with Trigeia.com), or a “merchant/ trainer” (which means you are a User, but allowed to offer and sell your unique services.) The term "User" refers to a Visitor, Client or a Trainer. You are only authorized to use the Trigeia Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the Trigeia Website and discontinue use of the Trigeia Services immediately. If you wish to become a User, communicate with other Members, Trainers and make use of the Trigeia Services, you must read this Agreement and indicate your acceptance during the registration process.

PERSONAL AND NONCOMMERCIAL USE LIMITATION

This web site is for your personal and noncommercial use. The content and information on this Web site (including, without limitation, price and availability of health, fitness and athletic services), as well as the infrastructure used to provide such content and information, is proprietary to Trigeia, Inc. or its suppliers and providers. Accordingly, as a condition of using this web site, you agree not to use this Web site or its contents or information for any commercial or non-personal purpose (direct or indirect). You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this web site. In addition, whether or not you have a commercial purpose, you agree not to: 1. Access, monitor or copy any content or information of this web site using any robot, spider, scraper or other automated means or any manual process for any purpose without express written permission of Trigeia, Inc.; 2. TERMS, CONDITIONS AND WARRANTIES

Users Profile Terms Please choose carefully the information you post on Trigeia.com and that you provide to other Users. Your Trigeia.com profile may not include the following items: telephone numbers, street addresses, last names, and any photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter. Despite this prohibition, information provided by other Trigeia.com Members (for instance, in their Profile) may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and Trigeia.com assumes no responsibility or liability for this material. If you become aware of misuse of the Trigeia Services by any person, please contact Trigeia or click on the "contact" link at the bottom of any Trigeia.com page. Trigeia.com reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of the Trigeia Services at any time, for any or no reason, with or without prior notice, and without liability. Trigeia expressly reserves the right to remove your profile and/or restrict, suspend, or terminate your access to any part of Trigeia Services if Trigeia determines, in its sole discretion, that you pose a threat to Trigeia and/or its Users.

  1. Eligibility. Use of and Membership in the Trigeia Services is void where prohibited. By using the Trigeia Services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 14 years of age or older; and (d) your use of the Trigeia Services does not violate any applicable law or regulation. Your profile may be deleted and your Membership may be terminated without warning, if we believe that you are less than 14 years of age. You agree as stated below in Fitness Agent that you are 18 and over, if using Trigeia services to purchase or sell products or services.
  1. Term. This Agreement shall remain in full force and effect while you use the Trigeia Services or are a Member. You may terminate your Membership at any time, for any reason, by following the instructions on the Member's Account Settings page. Trigeia.com may terminate your Membership at any time, without warning. Even after Membership is terminated, this Agreement will remain in effect.
  1. Fees. You acknowledge that Trigeia.com reserves the right to charge for the Trigeia Services and to change its fees from time to time in its discretion. If Trigeia.com terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of subscription fees.
  1. Password. When you sign up to become a Member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify Trigeia.com immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
  1. Non-commercial Use by Members. The Trigeia Services are for the personal use of Members only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Trigeia.com. Illegal and/or unauthorized use of the Trigeia Services, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Trigeia Website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles without notice and may result in termination of Membership privileges. Appropriate legal action will be taken for any illegal or unauthorized use of the Trigeia Services.
  1. Proprietary Rights in Content on Trigeia.com.
    1. Trigeia.com does not claim any ownership rights in the text, files, images, photos, video, sounds, works of authorship, or any other materials (collectively, "Content") that you post to the Trigeia Services. After posting your Content to the Trigeia Services, you continue to retain all ownership rights in such Content, and you continue to have the right to use your Content in any way you choose. By displaying or publishing ("posting") any Content on or through the Trigeia Services, you hereby grant to Trigeia.com a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content solely on and through the Trigeia Services. Without this license, Trigeia.com would be unable to provide the Trigeia Services.     2. The Trigeia Services contain Content of Trigeia.com ("Trigeia.com Content"). Trigeia.com Content is protected by copyright, trademark, patent, trade secret and other laws, and Trigeia.com owns and retains all rights in the Trigeia.com Content and the Trigeia Services. Trigeia.com hereby grants you a limited, revocable, nonsublicensable license to reproduce and display the Trigeia.com Content (excluding any software code) solely for your personal use in connection with viewing the Trigeia Website and using the Trigeia Services.
    3. The Trigeia Services contain Content of Users and other Trigeia.com licensors. Except for Content posted by you, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any content appearing on or through the Trigeia Services.

7. Content Posted.

  1. Trigeia.com may delete any Content that in the sole judgment of Trigeia.com violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. Trigeia.com assumes no responsibility for monitoring the Trigeia Services for inappropriate Content or conduct. If at any time Trigeia.com chooses, in its sole discretion, to monitor the Trigeia Services, Trigeia.com nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content.
    1. a. You are solely responsible for the Content that you post on or through any of the Trigeia Services, and any material or information that you transmit to other Members and for your interactions with other Users. Trigeia.com does not endorse and has no control over the Content. Content is not necessarily reviewed by Trigeia.com prior to posting and does not necessarily reflect the opinions or policies of Trigeia.com. Trigeia.com makes no warranties, express or implied, as to the Content or to the accuracy and reliability of the Content or any material or information that you transmit to other Members.
  1. Content/Activity Prohibited. The following is a partial list of the kind of Content that is illegal or prohibited to post on or through the Trigeia Services. Trigeia.com reserves the right to investigate and take appropriate legal action against anyone who, in Trigeia.com's sole discretion, violates this provision, including without limitation, removing the offending communication from the Trigeia Services and terminating the Membership of such violators. Prohibited Content includes, but is not limited to Content that, in the sole discretion of Trigeia.com:
    1. Is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
    2. Harasses or advocates harassment of another person;
    3. Exploits people in a sexual or violent manner;
    4. Contains nudity, violence, or offensive subject matter or contains a link to an adult website;
    5. Solicits personal information from anyone under 18;
    6. Provides any telephone numbers, street addresses, last names, URLs or email addresses;
    7. Promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
    8. Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
    9. Involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";
    10. Contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
    11. Furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
    12. Solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
    13. Involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
    14. Includes a photograph of another person that you have posted without that person's consent.
    15. criminal or tortuous activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;
    16. covering or obscuring the banner advertisements on your personal profile page, or any Trigeia.com page via HTML/CSS or any other means;
    17. any automated use of the system, such as using scripts to add friends or send comments or messages;
    18. interfering with, disrupting, or creating an undue burden on the Trigeia Services or the networks or services connected to the Trigeia Services;
    19. attempting to impersonate another Member or person;
    20. using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;
    21. selling or otherwise transferring your profile;
    22. using any information obtained from the Trigeia Services in order to harass, abuse, or harm another person;
    23. Using the Trigeia Services in a manner inconsistent with any and all applicable laws and regulations.
  1. Copyright Policy. You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of Trigeia.com to terminate Membership privileges of any Member who repeatedly infringes the copyright rights of others upon receipt of proper notification to Trigeia.com by the copyright owner or the copyright owner's legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on the Trigeia Services in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (ii) a description of the copyrighted work that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located on the Trigeia Services; (iv) your address, telephone number, and email address; (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  2. Member Disputes. You are solely responsible for your interactions with other Trigeia.com Members. Trigeia.com reserves the right, but has no obligation, to monitor disputes between you and other Members.
  3. Privacy. Use of the Trigeia Services is also governed by our Privacy Policy, which is incorporated into this Agreement by this reference.

USE OF TRIGEIA.COM FITNESS AGENT

The Trigeia.com Fitness Agent Application of this Web site is provided solely to assist customers in determining the availability of health, fitness and athletic-related goods and services and to make legitimate bookings or otherwise transact business with suppliers, and for no other purposes. You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to purchase or enter into any contracts with our suppliers on this Web site in accordance with all terms and conditions herein. You agree to be financially responsible for all of your use of this Web site (as well as for use of your account by others, including, without limitation, minors living with you). You agree to supervise all usage of this Web site by minors under your name or account. You also warrant that all information supplied by you or members of your household in using this Web site is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the fitness agent facilities of this Web site shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. You understand that overuse or abuse of these booking facilities of this Web site may result in you being denied access to such facilities. Separate terms and conditions will apply to your purchase of health, fitness and athletic-related goods and services that you select. You agree to abide by the terms or conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of products, or services. You understand that any violation of any such supplier’s conditions of purchase may result in cancellation of your booking(s) or purchase, in your being denied access to any training, in your forfeiting any monies paid for such booking(s) or purchase, and in Trigeia debiting your account for any costs Trigeia incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes and assessments arising out of the use of this Web site.

 

GENERAL


This agreement is governed by the laws of the State of California, USA. You hereby consent to the exclusive Jurisdiction and venue of courts in San Bernardino County, California, USA, in all disputes arising out of or relating to the use of this Web site. This Agreement is accepted upon your use of the Trigeia Website or any of the Trigeia Services and is further affirmed by you becoming a Member. This Agreement constitutes the entire agreement between you and Trigeia.com regarding the use of the Trigeia Services. The failure of Trigeia.com to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. Trigeia.com is a trademark of Trigeia, Inc. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.

 

PAYMENT POLICY

Trigeia.com uses PayPal to transfer funds into the users accounts. Each user must first load money onto their account in order to purchase goods or services. Once the goods and services are rendered by the trainer Trigeia will confirm and then pay out the money to the trainer by payment through Pay Pal or check. Each payment that is issued will be accompanied by the service charges that Pay Pal and Trigeia charge for use of this service. The break down for Pay Pal is 2% (not to exceed $1.00) plus 3.0% and 1.0% per transaction, Trigeia Inc. will charge 4% per transaction. Total amount charged for services equals 10%. Trigeia has the right to change the service charge as they see fit.

 

CASH OUT POLICY

The member that has added funds to their account and then wants to be refunded will have to contact Trigeia.com and ask for a cash out. Trigeia will then Transfer money into their Pay Pal account or send the member a check. Cash outs however do have consequences. The member will be charged 3.0% plus $0.30 per cash out. This fee will be paid to Pay Pal for their services.

 

CLIENT CANCELLATION POLICY

1. Trigeia has a 12 hour client cancellation policy for all training sessions that are booked through our system (Fitness Agent). If you are a client canceling a session you must cancel the session 12 hours before the session is set to begin. If you follow our cancellation policy you will be refunded your money to your Trigeia fund. 2. If the client or purchasing party does not give the trainer a 12 hour notice of cancellation they will not receive a refund and the trainer will be paid for their services. 3. If a client or any party books a session from a trainer and the trainer never acknowledges the session by changing the status on that session to accepted. The client or purchasing party can cancel the session before or after the 12 hour cancellation policy and be fully refunded.

 

TRAINER CANCELLATION POLICY

1. If a trainer cancels a session at any time they will not receive their pay for that session. 2. Trigeia requires trainers to provide the purchasing party a 12 hour notice of cancellation. This courtesy allows the client or purchasing party to search for another session on that same day. 3. If the trainer is not able to provide a 12 hour notice Trigeia reserves the right along with the client or purchasing party to lower the trainers rating. 4. If the purchasing party does not follow the 12 hour client cancellation policy the trainer will be paid for that session.
